Custody and Visitation Dispute Was Moot
In the unpublished decision of Headley v. Jewell, the Virginia Court of Appeals refused to hear an appeal of a trial court decision refusing dismissing a mother’s request for a change of custody concerning the parties’ son who was 18 years old. The Court held that the issue was moot since the Court only has the authority to decree custody and visitation of minor children. Since the “child” as issue in the case was 18, the Court lacked jursdiction to hear the case.
