Non-Custodial Parent Lacks Standing to Pursue First Amendment Claim on Child’s Behalf

The United States Supreme Court in Elk Grove Unified School District v. Newdow has ruled that where a parent is granted sole legal custody, the noncustodial parent does not have standing to pursue a claim of violation of the First Amendment on behalf of the child.
