ADHD Disabled Student Subject to Discipline for Computer Threat

In the federal district court case of AW v. Fairfax County School Board, an ADHD afflicted student who was a gifted and talented student was subject to discipline for placing a threatening message in another student’s computer file without any violation of the student’s rights under the Individuals with Disabilities Education Act (“IDEA”). The disciplinary action, a mid-year transfer, did not violate the “stay put” provisions of the IDEA.
