The court will render a decision on the trial date in Mrs. Hobbs has called and is in agreement that the order is accurate. It will be signed between now and the 19th by Mrs. Emery and Mrs. Hobbs (you will receive copies of letters showing it being sent from attorney to attorney. Then it will be delivered to the court on the 19th. The court will then sign the order and Mr. Pedro will have 10 days from that date to note his appeal. Then the case will move up from the Albemarle Juvenile and Domestic Relations District Court to the Albemarle Circuit Court. There will be a term day appearance and then the case will be set for trial at that time. The next term day in Albemarle Circuit Court is: February 26, 2009. However, because of the short period of time between February 19th and the 26th, the next term day might be March 26, 2009. Sometimes the clerk’s offices do not get the files transferred over to the circuit courts very quickly. Then, you are looking at a trial date in probably May or June, perhaps longer as the court’s docket is very busy. There is also the possibility of a interim hearing between the term day and the trial date to deal with things like evidentiary issues. But, that is fairly rare.
