Husband Able to Annul Marriage.

In the case of Mustafa v. Mustafa, the Virginia Court of Appeals, in an unpublished opinion, upheld a trial court’s ruling that a husband could annul his marriage to his wife on the basis of fraud. Husband was 55 years old and traveled to Pakistan to find a wife. He met his wife, who was 21 years old, and who had a young daughter.  Husband and wife discussed marriage and husband explained that he was“looking for “a nice young woman that [he] would have a nice sexual relationship.” He said that she told him “no problem.”  The parties never consummated their marriage either in Pakistan or upon their return to the U.S. After returning to the U.S., the wife told husband’s ex-wife later that she never planned on consummating the marriage.
