9th Circuit Declines to Hear Appeal of Prop 8 Same-Sex Marriage Case.

On June 5, 2012, the 9th Circuit refused to hear an appeal of a trial court’s ruling that the California ballot initiative bannining same sex marriages was unconstitutional. This article from the ABA Journal suggests that this decision combined with the 1st Circuit’s recent decison declaring DOMA unconstitutional makes it all the more likely that this issue will be headed to the U.S. Supreme Court.
