Wife Entitled to Fractional Share of Husband’s 10 Year Retirement Plan Including Years Worked After Agreement Retirement Date.

In the case of  Woloshin v. Woloshin, the Virginia Court of Appeals, in an unpublished opinion, held that there was no error in that part of judgment holding appellant shall pay to appellee one-half of marital share of full retirement benefit payments earned by appellant; but that there was error in that part of judgment regarding apportionment, taxation, and payment of retirement benefit payments.
