Wife Has to Repay Husband Spousal Support Paid After Wife Remarried.
In the case of Shelly Marie Smith, n/k/a Shelly S. Davis v. William Robert Smith, III, the Virginia Court of Appeals, in an unpublished opinion ruled that trial court did not err in ordering appellant to pay appellee restitution for spousal support payments made after the date of her remarriage where appellant failed to fulfill her affirmative duty to notify appellee of her remarriage as soon as it occurred under the terms of the parties’ settlement agreement.
